Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. 

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. 

To exercise the right of withdrawal, you must inform us (Terranova srl, Via Teodorico 7, 47922 Rimini ITALY, info@mareshop.eu) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the available model withdrawal form, but it is not obligatory. 

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. 

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of such reimbursement.  We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. 

Duty fees for extra EU withdrawals, if applied to Terranova upon items receipt, will be deducted from refundable amount. Original shipment costs for non EU orders are not refundable.

The Right of Withdrawal is governed by the Consumer Code and concerns only distance sales between the seller and private, non-professional consumers, so if you are a VAT number holder or a company, you cannot claim the Right of Withdrawal.

Right of withdrawal: exclusions

The right of withdrawal is excluded in the cases listed in art. 59 of Italian Legislative Decree. 205/2006.

In particular, it is excluded in cases of:

  • contracts for services already fully performed, with the express agreement of the consumer, and started before the expiry of the 14-day term for withdrawal. In this case, only the express acceptance by the consumer entails the loss of the right;
  • supply of goods or services whose price is linked to fluctuations in the financial market that the professional is not able to control and which may occur during the withdrawal period;
  • supply of goods made on-demand or clearly personalized;
  • supply of goods that are likely to deteriorate or expire rapidly;
  • supply of sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery;
  • supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;
  • contracts in which the consumer has specifically requested intervention by the professional for the purpose of carrying out urgent repair or maintenance work. If on the occasion of such intervention, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to such additional services or goods;
  • supply of sealed audio or video recordings or sealed computer software that has been unsealed after delivery;
  • supply of newspapers, periodicals, and magazines with the exception of subscription contracts for the supply of such publications;
  • contracts concluded at a public auction;
  • supply of digital content through non-material support if the execution has begun with the express agreement of the consumer and with his acceptance of the fact that in this case, he would have lost the right of withdrawal.
